Terms and Conditions of Use

The following are terms and conditions of use that constitute a legally binding agreement (“Agreement”) between you (whether as an individual or entity of any kind) and Maserati S.p.A., and Maserati North America, Inc. (collectively, “Maserati,” “we,” “our,” or “us”).

Accessing Maserati.com, Maserati.us, MaseratiAmerica.com or any other site controlled by us (collectively, the “Site”), interacting with the Site functions, inputting information into the Site, downloading, copying, and/or linking from or to the Site; or any other similar activities related to the Site constitute “Use” (including the various grammatical variations thereof) of the Site.

We may periodically audit your Use of this Site.  If we conclude that your Use is in violation of this Agreement, we may immediately block your access to the Site. This remedy is in addition to any other remedy available at law, the exercise of which shall be undertaken at our sole discretion.

We reserve the right to change and/or amend this Agreement at any time.  We are not obligated to provide you with advance notice of such changes nor which changes were made.  As such, you agree that it is your sole responsibility to periodically review this Agreement, the latest version of which will be available at this Site.

YOU AGREE THAT YOUR USE OF THIS SITE SUFFICIENTLY DEMONSTRATES YOUR CONSENT TO THE TERMS AND CONDITIONS IN THIS AGREEMENT.  Your Use also confirms that you agree to fully comply with any laws and regulations, including, but not limited to, U.S. export and re-export control laws and regulations applicable to the Site.

CHILDREN

No part of the Site is directed to persons under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, PLEASE DO NOT USE THE SITE.

INTELLECTUAL PROPERTY

All Site content, including, but not limited to, trademarks, text, images, audio, animation, video, layout and functionality (collectively, “Content”) is the exclusive property of Maserati or Maserati’s third party licensors. In particular, the Maserati name and Trident logo are registered trademarks of Maserati S.p.A. These trademarks may not be modified, used, downloaded, copied or distributed in any way or by any means unless part of an authorized download, copy or transmission of material on this Site.

You are only permitted to view the Content. Republication or redistribution of Content by any means, including, but not limited to, framing, mirroring, deep linking or similar means, is prohibited without our prior written consent.

You agree you will not use, directly or indirectly, any bot, spider, or other automatic method, nor any manual processes to copy or link to any Content on this Site.  You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Site.  You will not take any action, directly or indirectly, that we conclude imposes an unreasonable or disproportionately large load on any components of the Site or our, or our third party vendor’s, computer infrastructure underlying the Site.

Without limiting any of the foregoing, nothing in this Site shall be construed as granting you, by implication, estoppel or otherwise, any license or right to use, copy, modify, display, distribute, or create derivative works of any Content without our prior and express written consent in each instance.

The Content is protected by the laws of the United States and other countries.

The absence of an identification of a third party mark, or the lack of attribution of ownership of such mark on this Site, shall not be construed as any claim of rights by Maserati.

THIS SITE AND ALL OF ITS CONTENT ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” “WITH ALL FAULTS” BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, MASERATI DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, ARISING BY STATUTE, CUSTOM, COURSE OF DEALING, COURSE OF PERFORMANCE OR IN ANY OTHER WAY, WITH RESPECT TO THIS SITE, ITS CONTENT, AND ANY PRODUCTS OR SERVICES AVAILABLE OR PROMOTED THROUGH THIS SITE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, MASERATI DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES (A) OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE; (B) RELATING TO THE SECURITY OF THIS SITE; (C) THAT THE CONTENT OF THIS SITE IS ACCURATE, COMPLETE OR CURRENT; OR (D) THAT THIS SITE WILL OPERATE SECURELY OR WITHOUT INTERRUPTION OR ERROR.

APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OF CERTAIN WARRANTIES, SO ALL OR PART OF THESE DISCLAIMERS OF WARRANTIES MAY NOT APPLY TO YOU.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Maserati, its affiliates, licensors, business partners, officers, directors, employees, agents and assigns harmless from any loss, liability, claim, demand, damage or expense (including reasonable legal fees) asserted by any third party relating in any way to your Use or breach of this Agreement.  Without limiting the application of this section, Maserati reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you.

COPYRIGHT INFRINGEMENT POLICY

It is our policy to comply with all intellectual property laws and to act expeditiously upon receipt of a valid notice of claimed infringement.  If you believe a work has been reproduced in this Site in a manner that constitutes copyright infringement, please provide a notice of copyright infringement containing all of the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner for the purposes of the complaint.
  2. Identification of the material on the Site that is claimed to be infringing or to be the subject of the infringing activity.
  3. The address, telephone number or email of the complaining party.
  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.

TRANSMISSIONS

Any material, narrative, or data you transmit to us, by any means, will be treated as non-confidential.  Furthermore, by sending such information to us, you grant Maserati, its successors and assigns, a non-exclusive, world-wide, royalty free, perpetual, irrevocable license to use, copy and distribute such content in any manner, except as otherwise provided in the Privacy Statement.

MISCELLANEOUS & GOVERNING LAW

If any provision in this Agreement is held by a court of competent jurisdiction to be invalid, then such provision shall be construed as nearly as possible to correspond with Maserati’s intentions and without prejudice to Maserati as the drafter, and the remaining provisions in the Agreement shall remain unaffected.  Our failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision, unless previously and explicitly agreed to by us in writing.  The section titles in this Agreement are solely used for convenience and have no independent legal significance.  This Agreement may be assigned in whole or in part by us, but this Agreement may not be assigned by you.  This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, notwithstanding any conflict of laws provisions or rules.  You unequivocally, irrevocably and unconditionally: (i) consent to the exclusive jurisdiction of the state and federal courts sitting in the State of Delaware for any litigation or dispute arising out of relating to this Agreement; (ii) agree to waive a trial by jury; (iii) agree not to commence any litigation arising out of relating to this Agreement in any other jurisdiction; and (iv) agree not to plead or claim that such litigation is being brought in an inconvenient forum.

GENERAL INFORMATION

Without limiting any of the foregoing disclaimers, we make note of the following information:

  • Your actual gas mileage will vary depending on how you drive and maintain your vehicle.
  • Performance results may vary depending on vehicle specification and road and environmental conditions. Performance results were obtained by trained professionals on closed courses and should not be attempted on public roads. Maserati urges you to obey all traffic laws and all vehicle occupants to always wear their safety belts.
  • Maserati cars are factory equipped with low-profile high performance summer tires which are more susceptible to road hazards and consequential damages and may wear at an accelerated rate. Driving over rough or damaged road surfaces, as well as debris, curbs and other obstacles can cause serious damage to wheels, tires and suspension parts. Be careful to avoid road hazard and reduce your speed accordingly.
  • Summer tires are not recommended for driving in cold-weather conditions; Maserati recommends winter tires for cold-weather conditions. See your Maserati Dealer for available tire options.
  • Some images may show European models. Some models, equipment and accessories may not be available or may only become available after the car’s launch on the market. Maserati reserves the right to modify colors, designs and technical features at any time and without advance notice.

PRICING AND MSRP

The vehicle prices shown are approximate base MSRP in U.S. Dollars. MSRP listed may not include gas guzzler tax, dealer prep and transportation. Dealer price may vary. Taxes, title, license and registration fees are not included. Prices are subject to change without prior notice. Maserati reserves the right to modify colors, designs and technical features at any time and without prior notice. See your local authorized Maserati dealer for further details.
